These Terms of Use ("Terms") govern your access to and use of the Consista mobile application ("App") provided by Myriadloop (Pvt) Ltd ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Service Description

Consista is a habit tracking application that allows users to create habits, set schedules, log completions, and view progress metrics including scores, streaks, and calendar views. The App includes an optional AI-powered analysis feature that provides insights into habit correlations.

The App is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

3. User Accounts

The App can be used without creating an account. If you choose to sign in using Sign in with Apple or another authentication method:

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

The App offers a free tier with limited features and a Premium subscription with additional features including unlimited habits, AI Insights, reports, and cloud sync.

4.2 Subscription Terms

• Pricing: Premium is available at $9.99/month or $49.99/year. Prices may vary by region and are subject to change.
• Free Trial: New subscribers may be eligible for a 7-day free trial. If you do not cancel before the trial ends, you will be charged the subscription price.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Payment: All payments are processed through the Apple App Store or Google Play Store. We do not directly collect or store your payment information.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your device's App Store or Play Store subscription settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until then.
• Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
• No refunds are provided for partial billing periods.

5. User Responsibilities

When using the App, you agree to:

• Use the App only for its intended purpose of personal habit tracking.
• Not attempt to reverse engineer, decompile, or disassemble the App.
• Not use the App to transmit harmful, offensive, or illegal content.
• Not attempt to gain unauthorized access to our systems or other users' data.
• Not use automated systems or bots to interact with the App.
• Comply with all applicable laws and regulations in your jurisdiction.

6. Intellectual Property

The App, including its design, code, graphics, logos, icons, and content, is the exclusive property of Myriadloop (Pvt) Ltd and is protected by copyright, trademark, and other intellectual property laws.

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You retain ownership of any habit data and content you create within the App.
• "Consista" and the Consista logo are trademarks of Myriadloop (Pvt) Ltd.
• You may not use our trademarks without our prior written consent.

7. AI Features Disclaimer

The AI Habit Insights feature provides suggestions and correlations based on statistical analysis and artificial intelligence. These insights are for informational purposes only and should not be considered medical, psychological, or professional advice. We do not guarantee the accuracy or completeness of AI-generated insights.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYRIADLOOP (PVT) LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Myriadloop (Pvt) Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the App or your violation of these Terms.

12. Termination

• We may terminate or suspend your access to the App at any time, with or without cause or notice.
• You may stop using the App at any time by deleting it from your device.
• Upon termination, your license to use the App is immediately revoked.
• Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-App notifications. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the courts of Sri Lanka.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Myriadloop (Pvt) Ltd regarding your use of the App and supersede any prior agreements.
